What Does a Process Server Do and Why is it Important?

Process servers are a vital part of the U.S. legal system. Here in Florida, process servers play an even more crucial role, as most counties here require that process be served by only a sheriff or a certified private process server. With law enforcement already stretched thin, it is often quicker and more customer-friendly to use a private process server.

Process servers deliver court paperwork to its intended recipient, which is usually a defendant, witness, or subject matter expert. Court papers that process servers might deliver include:

  • Summons
  • Complaints
  • Motions
  • Subpoenas
  • Orders
  • Writs

Process servers deliver these court papers, collectively called process, by locating the intended recipient and handing them the paperwork in person. If the process server cannot locate the intended recipient to deliver the papers in hand, the court may allow the process server to deliver the paperwork via mail, in-person to another responsible party, or by publishing it in the local newspaper. Once the process server has satisfied the court’s requirement to deliver the paperwork, the recipient is considered to be served and the legal case will be heard at the scheduled hearing or trial date.

So, why must each person involved in a legal case be served in this way? Well, it’s a matter of constitutional rights. In the United States Constitution, it is mandated that each American receive due process. Due process requires that persons involved in legal matters be notified of upcoming hearings or trial dates related to the matter with enough time to prepare an adequate defense. This prevents someone from being accused in court with no time to mount a defense and also prevents people from being jailed for missing court dates they did not know existed.

While serving court documents is a process server’s principal job, some also do document retrieval and filing, skip traces, or even Private Investigator work.
